Acceptance of Agreement
By booking a trial class, submitting an enrollment application, paying tuition fees, or entering the physical studio premises of The Performerz Academy ("the Academy," "the Studio," "we," or "us"), you ("Student," "Performer," "Parent," or "Legal Guardian") agree to be legally bound by these Terms and Conditions.
If the student is under the age of eighteen (18) years, these terms must be agreed to and executed by a parent or legally recognized adult guardian.
Admissions, Eligibility & Demo Trials
Admission to specific training levels (Foundational, Intermediate, Advanced Company) is subject to assessment by our certified faculty directors.
- Trial & Demo Class Bookings: Demo class slots booked via our website or WhatsApp are subject to schedule availability. The Academy reserves the right to reschedule trial sessions with advance notice.
- Batch Allocation: Placement in specialized batches (e.g. Acrobatics, Aerial Poise, Contemporary Release) is determined by age, physiological readiness, and technical proficiency to ensure a safe learning environment.
- Right of Refusal: The Academy reserves the right to decline or suspend admission to any individual whose conduct is disruptive, unsafe, or contrary to the ethos of the atelier.
Athletic Demands & Physical Risk Waiver
Performing arts, dance, gymnastics, tumbling, and aerial silks involve rigorous cardiovascular exertion, flexibility conditioning, elevation, and acrobatic maneuvering.
You acknowledge that participation in dance and acrobatics carries inherent physical risks (including muscle strains, sprains, falls, or unforeseen injuries). You voluntarily assume all risks associated with participation and affirm that you (or your enrolled minor) are in sound physical health with no undisclosed medical conditions restricting intense physical activity.
- Students must immediately inform instructors of any discomfort, dizziness, pain, or existing injury prior to or during warm-ups and choreography drills.
- Aerial apparatus (silks, hoops) and tumbling crash mats must only be utilized under the direct active supervision of a certified Performerz instructor.
Medical Emergency Authorization
In the rare event of an acute medical emergency occurring on studio premises where the emergency contact cannot be immediately reached, you authorize The Performerz Academy faculty and staff to secure necessary emergency medical assistance, first aid, or hospital transport. Any medical expenses incurred from external emergency care providers remain the financial responsibility of the student or parent/guardian.
Tuition Fees, Payment Terms & Refund Policy
Tuition fees support the continuous maintenance of state-of-the-art sprung dance floors, certified aerial rigging, high-fidelity acoustics, and master-level pedagogical instruction.
- Advance Tuition: Term and monthly fees must be paid in full prior to the start of each training cycle.
- Strict No-Refund Policy: Tuition fees paid are strictly non-refundable and non-transferable once the batch has commenced. No refunds or fee prorations are provided for student absences, voluntary dropouts, or personal scheduling conflicts.
- Medical Freeze Option: In cases of medically certified severe injuries preventing training for more than four (4) consecutive weeks, a formal request accompanied by certified physician documentation may be evaluated for a tuition credit freeze.
Studio Etiquette & Attire Code
To maintain the highest standards of safety, discipline, and artistic focus, all students agree to adhere to the Atelier Etiquette Code:
- Punctuality: Dancers must arrive at least 10 minutes prior to scheduled batch times. Proper warm-ups are mandatory to prevent severe muscle strain; late arrivals exceeding 15 minutes may be restricted from strenuous exercises.
- Studio Attire: Form-fitting dancewear (leotards, leggings, athletic tights). Baggy clothing, loose jewelry, wristwatches, and sharp hairpins are strictly prohibited on aerial apparatus and tumbling mats.
- Footwear: Specialized dance shoes (contemporary socks, ballet slippers, or bare feet depending on syllabus). Outdoor footwear is never permitted on sprung studio dance floors.
- Respect & Inclusivity: Zero tolerance for discrimination, bullying, harassment, or disrespectful behavior toward fellow performers, instructors, or staff.
Attendance & Make-up Class Guidelines
Consistent attendance is vital for group choreography cohesion and safe progressive conditioning:
- Dancers should provide prior notice via WhatsApp/Email if they will miss a scheduled class.
- Make-up classes are offered subject to batch availability and instructor approval within the current active billing cycle. Unused make-up sessions do not carry forward into subsequent terms.
- The Academy reserves the right to adjust batch schedules during public festivals, national holidays, or special masterclass events.
Intellectual Property & Choreography Rights
All original choreographic works, curriculum frameworks, syllabi, routine sequences, music edits, branding logos, visual designs, and pedagogical methodologies created by The Performerz Academy instructors remain the exclusive intellectual property of the Academy.
Students and third parties may not use, teach, perform commercially, or distribute Academy routines for external commercial gain without prior written authorization from the Academy Artistic Director.
Limitation of Liability & Indemnity
To the maximum extent permitted by applicable Indian law:
- The Performerz Academy, its directors, coaches, and staff shall not be liable for any indirect, incidental, special, or consequential damages resulting from athletic participation or loss of personal property in studio changing areas.
- Students and guardians agree to indemnify and hold harmless The Performerz Academy from any claims, liabilities, damages, or legal expenses arising from a breach of studio safety rules or willful misconduct.
Governing Law & Dispute Resolution
These Terms and Conditions shall be governed by and construed in accordance with the laws of the Republic of India.
Any dispute, controversy, or claim arising out of or relating to enrollment or atelier operations shall first be submitted to mutual amicable mediation. Should mediation fail, the dispute shall be subject to the exclusive jurisdiction of the competent civil courts in Mumbai, Maharashtra, India.
